AZ Political news Legislator opposes child prostitution bill

A bill that would stiffen penalties for those who force children into prostitution has new life, despite an influential East Valley lawmaker’s attempts to kill it.

The chairman of the Arizona House Judiciary Committee, Rep. Eddie Farnsworth, R-Gilbert, has been very critical of a provision in the bill that would bar someone accused of sexually exploiting a child to argue that he or she didn’t know the victim was 15 to 17 years old.

Currently, a defendant accused of pushing a child into prostitution can evade tougher punishments by successfully arguing he or she didn’t know the victim was a minor. But Farnsworth has warned that striking that provision from state law could hurt defendants who are wrongfully accused of a crime.

The measure, SB1268, is backed by law enforcement and was recommended by a committee focused on addressing prostitution. Since the bill was introduced early this year, it has gained wide support. In fact, it was passed by the Senate unanimously.

A bill that would toughen penalties on people who push children into prostitution moved forward Monday after being stalled for the past 2 1/2 months.

The House of Representatives approved the bill on a voice vote, moving it toward a final vote. It joins another bill that has the same aim, raising the question of which bill will prevail.

Monday's action gives the green light to Senate Bill 1268, which increases the penalty for anyone who tries to entice a person under 18 years old into prostitution. The penalty would be a Class 2 felony, punishable by up to 10 years in prison.

Arizona received poor grades in a new study examining how U.S. states deal with the international trafficking of women and girls, including for prostitution and forced labor and servitude.

The poor marks come at the same time as a bill in the Arizona Legislature to toughen child prostitution penalties has been stalled by Republican lawmakers.

The Center for Women Policy Issues gives Arizona failing grades when it comes to protecting trafficking victims; regulating international marriage brokers (i.e. mail-order brides) and regulating travel agencies that promote or facilitate sexually oriented tourism.

AZ Political news Child-prostitution bill clears hurdle

The Arizona Republic

A bill that toughens the penalties for people who push children into prostitution cleared a stubborn hurdle in the Legislature Wednesday but faces opposition from lawmakers who believe it could become a trap for people who are wrongfully accused.

The measure has been championed by Phoenix Councilwoman Peggy Bilsten and resulted from recommendations made by an ad hoc task force on prostitution. Among other provisions, it would disallow the legal defense that a defendant did not know the victim was between the ages of 15 and 17.

"The biggest thing for us is it would take away the defense," Bilsten said, after the bill passed out of the Natural Resources and Public Safety Committee on a 9-1 vote after being stalled there several weeks.

AZ Political news Bill, victims await a champion

... Senate Bill 1268, which enhances penalties on both the pimp and the john, making child prostitution with a 15-, 16- or 17-year-old a felony, is facing an uncertain future in the state House of Representatives.

It needs a legislative champion, especially in the House. It needs the focus of law enforcement officials and lawmakers to make sure this bill reaches the floor for an up-and-down vote.
