State lawmakers voted Tuesday to give some additional legal protections to firms that employ the disabled but don’t pay them the new votermandated minimum wage.
HB2245 spells out that these companies cannot be prosecuted if they are following the guidance of a new policy adopted earlier this year by the state Industrial Commission. That policy redefined what is an “employee,” meaning who is covered — and who is not — by the new law.

But some legal questions remain whether a policy statement can overrule a voter-approved law. This change is designed to provide some legal cover.

 Wage law still peril to jobs of disabled
The Arizona Republic
One of the Valley's largest work centers for people with disabilities is still up and running, and nearly 100 employees furloughed this year are back at work.
But the Centers for Habilitation, based in Tempe, is operating apprehensively.
If the Legislature doesn't step in before the session ends in a few weeks and create an exemption to the new state minimum wage law that allows lower wages to disabled employees, as many as 70 TCH workers could lose their jobs permanently. And in the meantime, the 40-year-old non-profit fears it could be vulnerable to lawsuits.

 Cutting funds for blind kids defended
The Arizona Republic.
A state lawmaker defended a proposed $1 million funding cut from a program serving blind and visually impaired preschoolers through the Phoenix-based Foundation for Blind Children.
The Arizona State Schools for the Deaf and the Blind, which contracts with the foundation to serve about 75 preschoolers a year, had requested that the state take away the money.
That's why Rep. Nancy McLain, R-Bullhead City, said legislators took a voice vote last week to approve a decrease in funding over the next two years from the state-run agency's budget.

 Wage law doesn't exempt disabled
The Arizona Daily Star has the story.
PHOENIX — A voter-approved state minimum-wage law contains no exemption for disabled workers who used to be able to be paid less, Attorney General Terry Goddard concluded Wednesday.
In a formal legal opinion, Goddard acknowledged that federal law allowed employers to pay people with limited abilities a "commensurate" wage — some percentage of the $5.15 an hour federal minimum.
