State official's use of e-mail falls in gray area

Richard Fimbres, head of the Governor's Office of Highway Safety, used his state e-mail in announcing an immigration forum hosted by congressman Raúl Grijalva.

The Arizona Department of Administration checked into this and found that Fimbres was in his rights to use his state e-mail because it was not a "solicitation" of money or support, said Alan Ecker, an agency spokesman.

Technically, the forum is not political activity, per se, in a literal kind of way. The forum is being co-hosted by U.S. Rep. Luis Gutierrez, the Illinois Democrat sponsoring the House immigration reform bill. The meeting is open to the public and sponsored by the Pima County Interfaith Council, Chicanos Por La Causa, the Tucson Hispanic Chamber of Commerce, Jewish Community Relations, Border Action Network, League of United Latin American Citizens and the Hispanic National Bar Association. They may not be political parties, but somehow The Minutemen were left off the invite list.
